1. Scope
These Terms and Conditions (T&Cs) apply to all contracts concluded between Segismundo Zamora Flore (hereinafter "Provider") and customers (hereinafter "Customer") via the website munayleben.com.
The Provider offers digital and physical products as well as services in the areas of spiritual development, energy medicine, and personal growth.
2. Formation of Contract
2.1 Offer
The presentation of products and services on the website does not constitute a legally binding offer, but rather an invitation for the Customer to submit an offer.
2.2 Order Process
By submitting an order via the online booking form or by email, the Customer makes a binding offer to conclude a contract. The contract is formed when the Provider accepts the order by means of a written order confirmation or by providing the service.
2.3 Contract Language
The contract language is German.
3. Services and Prices
3.1 Description of Services
The Provider offers the following services:
- Energy Medicine Training: Multi-month training in Andean energy medicine (online and in-person)
- Individual Sessions: Personal consultation and energetic treatment (online and in-person)
- Group Courses and Retreats: Weekend and week-long courses on various topics
- Peru Journeys: Spiritual journeys to Peru
- Membership: Monthly access to exclusive content
- Digital Products: Online courses, meditations, e-books
3.2 Prices
All prices are in euros (€) and include the applicable statutory VAT. The current prices are stated on the website.
3.3 Payment Terms
Payment is made by bank transfer, credit card, PayPal, or SEPA direct debit (for memberships). When booking a training or journey, a deposit of 30% of the total amount is due. The remaining balance must be paid no later than 14 days before the start of the event.
4. Right of Withdrawal
4.1 Right of Withdrawal for Distance Contracts
Consumers have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.
4.2 Exceptions to the Right of Withdrawal
The right of withdrawal expires prematurely for contracts for the provision of services if the Provider has fully performed the service and performance of the service only began after the consumer gave their express consent and simultaneously confirmed their knowledge that they would lose their right of withdrawal upon full performance of the contract by the Provider.
The right of withdrawal does not apply to:
- Individual sessions that have already commenced or been fully completed
- Online courses that have already commenced or been fully completed
- Events that take place on a specific date (e.g. Peru journey, retreats)
4.3 Withdrawal Declaration
To exercise the right of withdrawal, the Customer must send the Provider a clear statement of their decision to withdraw from this contract.
5. Cancellation Policy
5.1 Individual Sessions
Appointments for individual sessions may be rescheduled or cancelled free of charge up to 48 hours before the agreed time. In the event of later cancellation or non-attendance without prior notice, the full fee will be charged.
5.2 Courses and Training
- Cancellation up to 30 days before the start: refund minus a 10% processing fee
- Cancellation 14–29 days before the start: 50% refund
- Cancellation less than 14 days before the start: no refund, but transfer to a later event is possible
5.3 Peru Journey
- Cancellation up to 90 days before the start: refund minus a EUR 500 processing fee
- Cancellation 60–89 days before the start: 50% refund
- Cancellation less than 60 days before the start: no refund
Travel cancellation insurance is recommended.
6. Liability
6.1 Limitation of Liability
The Provider is liable without limitation for intent and gross negligence, as well as for injury to life, body, and health. For ordinary negligence, the Provider is only liable in the event of a breach of essential contractual obligations (cardinal duties).
6.2 Health Suitability
Participation in the courses and sessions offered requires adequate physical and mental health. In the case of existing health problems, it is recommended to consult a doctor beforehand. The Provider is not liable for health damage attributable to a pre-existing condition for which the Provider is not responsible.
6.3 Medical Notice
The services offered do not replace medical or psychotherapeutic treatment. Customers experiencing health complaints are advised to consult a doctor or naturopath.
7. Privacy
The Provider handles the Customer's personal data confidentially and in accordance with the applicable data protection regulations. For details, please refer to the Privacy Policy.
8. Copyright
All content, materials, and recordings provided as part of the courses and memberships are protected by copyright. Reproduction, distribution, or public performance requires the express written consent of the Provider.
Personal use for one's own learning process is permitted. Commercial use or passing on to third parties is prohibited.
9. Code of Conduct
The Customer undertakes to behave respectfully and considerately towards other participants and the Provider during events. In the event of violations of these rules, the Provider reserves the right to exclude the Customer from participation without entitlement to a refund.
10. Membership
10.1 Term and Termination
The membership runs for an indefinite period and may be terminated on a monthly basis. Notice of termination must be given no later than 7 days before the next billing date.
10.2 Membership Content
The exact scope of the membership is described on the website. The Provider reserves the right to adjust the content of the membership in order to improve quality.
11. Severability Clause
Should individual provisions of these T&Cs be or become wholly or partially invalid, the remainder of the contract shall remain in force. The invalid provision shall be replaced by the applicable statutory regulations.
12. Place of Jurisdiction
If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be Hamburg.
13. Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
